Welcome to Bitcoinanonimi. These Terms of Use (the "Terms") govern your access to and use of the Bitcoinanonimi website, interfaces and related services (together, the "Service"). Please read them carefully: they define your rights and obligations, describe the scope of the Service and limit our liability.
The terms "Bitcoinanonimi", "we", "us" and "our" refer to the Service and to the individual(s) or entity operating it. The terms "User", "you" and "your" refer to any person or entity accessing or using the Service.
By accessing or using the Service you confirm that you have read, understood and agree to be legally bound by these Terms and by our Privacy Policy. These Terms contain a binding arbitration clause and a waiver of class actions (see Section 20). If you do not agree, you must not use the Service.
1. Definitions
- Digital Asset: any cryptographically secured digital representation of value supported by the Service, such as Bitcoin (BTC) and Monero (XMR).
- Swap: the process, initiated by a User through the Service, by which one Digital Asset is exchanged for another, or for the same Digital Asset delivered to a new address. A Swap may involve one or more Blockchain Transactions.
- Blockchain Transaction: a transaction recorded on a public distributed ledger.
- Deposit Address: the address shown to you by the Service, to which you send the Digital Asset you wish to swap.
- Destination Address: the address you provide to receive the resulting Digital Asset.
- Refund Address: an optional address you provide, in the Digital Asset you send, to which refunds can be returned.
- Third-Party Provider: any independent exchange, liquidity provider, swap aggregator, blockchain node or other third party involved in executing a Swap.
- Quote: an indicative or estimated exchange rate and output amount displayed before a Swap is created.
- Network Fee: the fee charged by a blockchain network to process a Blockchain Transaction, which is outside our control.
- Order ID: the unique identifier assigned to each Swap, required for tracking and support.
2. Nature of the Service
Bitcoinanonimi is a non-custodial cryptocurrency swap service. It provides a technical interface that automatically routes your Swap through Third-Party Providers. We do not:
- hold or ask for your private keys, seed phrases or wallet passwords;
- store user balances or provide custodial wallets;
- operate user accounts, trading accounts or deposit accounts;
- provide banking, brokerage, investment, escrow or safekeeping services.
No registration is required. Each Swap is processed independently and automatically, and control of your funds remains with you until you send them to execute a Swap. Bitcoinanonimi is not a bank, a financial institution or a money transmitter, and nothing on the Service constitutes an offer or solicitation to buy or sell any financial instrument.
3. Eligibility and Restricted Use
By using the Service you represent and warrant that:
- you are at least 18 years old, or the age of legal majority in your jurisdiction if higher, and have full legal capacity to accept these Terms;
- you are the lawful owner of the Digital Assets you send, or are duly authorized to use them, and they do not derive from any unlawful activity;
- you are not located in, or a resident or national of, any country or territory subject to comprehensive sanctions, and you are not listed on, or owned or controlled by anyone listed on, any sanctions list;
- your use of the Service is lawful in your jurisdiction. You are solely responsible for determining whether the Service is legal where you are, and for complying with all laws applicable to you, including tax reporting obligations.
The Service is not intended for use in any jurisdiction where it would be unlawful. We make no representation that the Service is appropriate or available in any particular location.
4. How a Swap Works
- Quote. You select the Digital Assets and the amount. The Service displays a Quote based on the best offer available from Third-Party Providers at that moment. Quotes are valid for a limited time only.
- Addresses. You must provide a valid Destination Address and you may, and are strongly encouraged to, provide a Refund Address. You are solely responsible for the accuracy of every address you enter.
- Deposit. Once the Swap is created, you receive a Deposit Address. You must send the exact amount of the specified Digital Asset, on the correct network, within the time window indicated. Deposits sent late, in a different amount, in a different asset or on a different network may be delayed, processed at a different rate, returned or lost.
- Processing. Processing starts only after the required number of network confirmations. Timing depends on blockchain conditions, network congestion and the availability of Third-Party Providers, and is never guaranteed.
- Completion. A Swap is completed once the resulting Digital Asset has been sent to the Destination Address. Blockchain Transactions are irreversible: once sent, funds cannot be recalled.
- Order ID. Keep your Order ID. It is the only way to track your Swap and to obtain support, since we do not maintain user accounts.
5. Fees, Rates and Estimates
- Our service fee and the fees of Third-Party Providers are already included in the Quote and in the estimated amount you receive. No hidden fees are added.
- Unless a rate is expressly indicated as fixed, Quotes and output amounts are estimates. The final amount may differ because of market volatility, provider spreads, Network Fees and the time required for confirmations, in particular for Swaps that involve more than one step.
- Any percentage or fiat value shown (for example, the estimated total fees or an equivalent value in EUR) is indicative only and is based on third-party market data that we do not control.
- Network Fees are set by the respective blockchain networks and are outside our control.
- Minimum and maximum amounts may apply. Fees, limits and supported assets may change at any time without notice; changes do not affect Swaps already created.
6. Third-Party Providers
Swaps are executed by independent Third-Party Providers selected automatically by the Service. We do not control, endorse or guarantee these providers and are not responsible for their acts, omissions, availability, rates, policies or compliance procedures. In particular, a Third-Party Provider may, at its sole discretion and under its own terms, delay, suspend, refuse or refund a transaction, or request additional information before releasing funds. We will reasonably assist you in communicating with the relevant provider, but we cannot override its decisions.
Links to third-party websites (such as wallets or VPN services) are provided for convenience only and do not imply any endorsement or responsibility on our part.
7. Your Responsibilities
You are solely responsible for:
- providing correct and compatible Destination and Refund Addresses;
- sending the correct asset and amount, on the correct network, within the indicated time window;
- reviewing all Swap details before confirming;
- the security of your devices, wallets and private keys;
- verifying that you are on the official website and protecting yourself from phishing and impersonation;
- keeping your Order ID.
We cannot recover funds sent to a wrong, incompatible or unsupported address, or lost as a result of your error, and we accept no liability for such losses.
8. Refunds, Failed and Halted Swaps
- All completed Swaps are final and cannot be reversed or cancelled.
- If a Swap cannot be completed (for example, because it expired, failed technically or was halted by a Third-Party Provider), any refund is processed, where technically possible, to the Refund Address you provided or, if none was provided, according to the instructions you give our support team.
- Refunds may be reduced by Network Fees and by any rate difference, and are subject to the technical feasibility and the policies of the Third-Party Providers involved.
- Third-Party Providers retain Swap data for a limited time only. Contact our support promptly, quoting your Order ID: we may be unable to assist with requests made after that data is no longer available.
- We are not responsible for delays in refunds caused by Third-Party Providers, network conditions or missing or incorrect information provided by you.
9. Prohibited Activities
You agree not to use the Service, directly or indirectly, to:
- engage in, facilitate or conceal any unlawful activity, including money laundering, terrorist financing, fraud, tax evasion, ransomware, the financing of weapons or trade in illegal goods or services;
- process Digital Assets that are stolen, obtained by fraud or otherwise derived from criminal activity;
- evade sanctions or any legal restriction applicable to you;
- interfere with, disrupt, overload or attempt to gain unauthorized access to the Service or its infrastructure;
- probe, scan or exploit vulnerabilities, or use bots, scrapers or other automated means beyond normal use without our prior written consent;
- impersonate Bitcoinanonimi, its team or any other person, or create confusingly similar websites;
- violate these Terms or the rights of any third party.
10. Right to Refuse, Delay or Suspend
We may, at our sole discretion and without prior notice, refuse, delay, suspend or cancel any Swap, or restrict access to the Service, in cases including technical instability, network congestion, unavailability of Third-Party Providers, suspected violation of these Terms, suspicious or irregular activity, risk signals, or where required by applicable law. Where a Swap cannot be completed, we will make reasonable efforts to have the funds returned in accordance with Section 8. We may modify, suspend or discontinue the Service, or any part of it, at any time.
11. Risk Disclosure
By using the Service you acknowledge and accept that:
- the prices of Digital Assets are highly volatile and may change significantly while a Swap is being processed;
- Blockchain Transactions are irreversible, and errors may result in the permanent loss of funds;
- blockchain networks may suffer congestion, forks, attacks or failures beyond our control;
- Third-Party Providers may delay, suspend or refuse transactions;
- laws and regulations concerning Digital Assets vary by jurisdiction and may change, possibly affecting your ability to use the Service;
- no system is completely secure, and privacy technologies cannot guarantee absolute anonymity.
You use the Service entirely at your own risk.
12. No Financial Advice
Nothing provided through the Service, including guides, articles, estimates or communications, constitutes financial, investment, legal or tax advice. You are solely responsible for your decisions and transactions and should seek independent professional advice where appropriate.
13. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and uninterrupted or error-free operation. We do not guarantee any particular rate, output amount, processing time or result.
14. Limitation of Liability
To the maximum extent permitted by law, Bitcoinanonimi and its operators, team members and partners shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of profits, revenue, data, Digital Assets, goodwill or opportunity, arising out of or relating to the Service or these Terms, even if advised of the possibility of such damages. This includes losses caused by user error, Third-Party Providers, blockchain networks, market movements, phishing or unauthorized access to your devices or wallets.
In any event, our total aggregate liability for any claim arising out of or relating to a Swap shall not exceed the service fee actually received by us for that Swap.
15. Indemnification
You agree to indemnify, defend and hold harmless Bitcoinanonimi and its operators, team members and partners from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of or relating to your use of the Service, your breach of these Terms or your violation of any law or of the rights of any third party.
16. Intellectual Property
All content of the Service, including its name, logo, design, texts, graphics and software, is owned by or licensed to Bitcoinanonimi and is protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from it, or use our name or logo, without our prior written consent.
17. Privacy
We are committed to data minimization. How we process the limited data needed to operate the Service is described in our Privacy Policy, which forms an integral part of these Terms.
18. Force Majeure
We shall not be liable for any delay or failure to perform caused by events beyond our reasonable control, including blockchain network failures, forks or congestion, failures of Third-Party Providers, internet or power outages, cyberattacks, natural disasters, epidemics, war, governmental actions or changes in law.
19. Changes to these Terms
We may amend these Terms at any time by publishing the updated version on this page and updating the "Last updated" date. Changes take effect upon publication and do not apply to Swaps created before that date. Your continued use of the Service after the publication of changes constitutes your acceptance of the updated Terms.
20. Dispute Resolution
Before starting any formal proceeding, you agree to contact us and attempt in good faith to resolve the dispute informally for at least 30 days.
Any dispute, claim or controversy arising out of or relating to these Terms or the Service that is not resolved informally shall be settled exclusively by final and binding arbitration conducted under internationally recognized arbitration rules, in the English language, by a single arbitrator. To the maximum extent permitted by law, you waive any right to bring claims before a court or to a jury trial, and you agree that claims may be brought only on an individual basis and not as a plaintiff or class member in any class, collective or representative action.
21. General Provisions
- Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
- Severability. If any provision is held invalid or unenforceable, it shall be limited to the minimum extent necessary and the remaining provisions shall remain in full force and effect.
- No waiver. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Assignment. You may not assign or transfer your rights under these Terms. We may assign ours without restriction.
- Language. These Terms are drafted in English. Any translation is provided for convenience only; in case of conflict, the English version prevails.
